The General Contracting terms regulate the distance selling relationship between MUMKASHOES SL and the user or client, in compliance with the legal clauses, specifically, Law 7/1998, from the 13th of April, regarding the General Contracting Terms, Law 3/2014, from the 27th of March, which led to the modification of the rewritten General Law for the Defense of Consumers and Users, the Organic Law 15/1999, from the 13th of December, regarding the Protection of Personal Data, Law 7/1996, from the 15th of January, regarding the Ordinance of Retailer Commerce, and Law 34/2002, from the 11th of July, regarding Information Society Services and Electronic Commerce. MUMKASHOES SL reserves the right to perform the modifications it feels appropriate, without prior notice, of the General Terms. These modifications can be made through its websites in any way that is permitted by the law and they must comply during the period of time in which they are published on the website and until they are not modified in a valid manner subsequently.

MUMKASHOES SL provides national (excluding the Canary Islands, Ceuta, and Melilla) and international delivery in the following countries:
Spain (excluding Islas Canarias, Ceuta y Melilla) , Portugal, France, Germany , Austria, Belgium, Bulgaria, Croatia, Czech Republic, Estonia, Hungary, Ireland, Latvia, Lithuania, Luxembourg, Slovakia, Slovenia, Denmark, Finland, Gibraltar, Greece, Italy, Malta, Netherlands, Norway, Romania, San Marino, Sweden, Switzerland, United Kingdom.
Deliveries made within the Spanish territory (excluding the Canary Islands, Ceuta and Melilla) will be free when spending 50€ or more and will include delivery costs, transport, and insurance.
As for international deliveries (as well as Canary Islands, Ceuta and Melilla), customs costs aren’t included nor are other taxes (customs duty); it is the recipient at the destination who must pay in cash to receive the merchandise. Thus, the recipient will be responsible for all the importation costs and tax that is generated at the destination’s customs, whether the merchandise is handed into him/her or if he/she doesn’t take care of it.
We will attempt to deliver the order in the least amount of time possible, but the recipient must keep in mind the regulation of the country of destination for the importation of the requested articles since MUMKASHOES SL has no responsibility in this aspect. DELIVERY OF THE ORDER
Once the Delivery Confirmation is sent, the Product will be delivered to the address that the user indicated when carrying out the Order in a period of between two and five (2-5) working days from the moment it leaves the MUMKASHOES SL warehouse within Spanish territory, including here Canary Islands, Ceuta and Melilla. International orders will take different delivery times depending on the destination. This may take five to twenty (5-20) working days.
MUMKASHOES SL doesn’t take responsibility if the product isn’t delivered as a consequence of the information provided by the User being false, inexact or incomplete or if the delivery can’t be completed because of external circumstances that affect the delivery company which has been assigned, such as the absence of the User or the retention of the Product in Customs.
The delivery deadlines are approximate, although MUMKASHOES SL will always try to adjust to them. However, MUMKASHOES SL commits to deliver the order in a maximum of 30 days, starting the day after the order.
PAYMENT METHODS AND EXECUTION OF THE ORDER
The client can pay his/her order in any of the following methods. During the purchase process he/she must indicate his/her election:

The availability of the products offered by MUMKASHOES SL can vary depending on the demands of clients. In the case of no execution because of unavailability, MUMKASHOES SL will notify the client at the moment it is aware of the situation through email. The period of this communication will never surpass a maximum of 30 days. MUMKASHOES SL can offer the double option of supplying the client, without an increase in price, a product with similar characteristics or with superior quality, or barring justified and demonstrable reasons by MUMKASHOES SL in that same period, returning the amount paid for the canceled order. If MUMKASHOES SL doesn’t pay this amount in the indicated period of time, the buyer can demand that he is paid double the amount without harming his/her right to compensation.
RIGHT TO WAIVER, REFUNDS, AND CLAIMS
The buyer has a minimum deadline of fourteen natural days to waive, starting on the day that the client receives the product, without any penalization or indication of the reasons.
The exercise of the right to waive must be carried out through a notification via telephone from Monday to Friday from 9 am to 6 pm, sending an email to firstname.lastname@example.org, sending your written document to our address Pallars Street 193, “Spaces” Centro de Negocios, 08005 BARCELONA, or through our waiver form in our website.
According to what appears on article 103 of Law 3/2014, from the 27th of March, which led to the modification of the rewritten General Law for the Defence of Consumers and Users, the supply of services or goods that are prepared according to the specifications of the consumer or clearly personalized, or that, due to their nature, cannot be returned or could deteriorate or expire quickly, are exempt from being waivered.
- Returns/Size Change
Once the item is received, the customer has 14 days to return or exchange any product that he/she wants to. If the client wishes to change size or exchange the received product for another one, the item previously received has to be returned to MUMKASHOES SL and then, place another order. In order to carry out this exchange/return/size change properly, the client must send an email to email@example.com with the order reference, the reason why he/she wishes to return or exchange the product and his/her contact details. MUMKASHOES SL will contact the client and inform him/her about the procedure that needs to be followed.
MUMKASHOES SL will take care of the shipping costs of the exchange for the next countries: Spain, Germany, Austria, Francia, Portugal. For the rest of the world, the shipping costs of the return/exchange should be covered by the customers. In this case, any cargo company can be choosen freely.
In case of returns, the shipping cost is not refunded.
In every case, the products that are returned and/or exchanged must be in perfect condition, must not have been used and be in its original packaging. We, therefore, ask for the package to be appropriately protected and sealed to avoid problems in its transport. Once we receive them/it, we will verify their/its state. Once we verify that both the article/s and the possible components, accessories, promotional gifts and documentation are complete and in perfect condition, we will proceed to refund.
In the case of an unjustified delay, within 21 natural days, on MUMKASHOES SL’s behalf regarding the refund, the client can demand double the amount of what was paid without harming his/her right to be compensated for the damage suffered when it exceeds the amount.
- Return of a faulty product
In the case of a product not being in a good state and the causes not being a consequence of the client, he/she will have the right to return the product, informing MUMKASHOES SL of the reason for the return through any of the means facilitated in the present contracting terms, and with no additional cost for the client. This return because of the imperfection of the poor state of the product won’t be considered a right to waiver. In this case, MUMKASHOES SL commits to assume the cost of the refund and substitute the product for a new one in compliance with the terms that were accepted moment of sale.

If any controversy were to arise, the parties could subject their conflicts to arbitration or resort to ordinary jurisdiction by obeying the regulations regarding jurisdiction and competence.
